UPDATE: Module 3: Physician Practice Standards and Licensure
Physician Licensure Policy Requirements
Telemedicine Out-of-State Guidance for BCM Physicians
Updated 4/1/2020
At the request of the ICC, Risk Management/General Counsel’s office and the Telehealth, task force conducted a review of licensure requirements and telehealth (telemedicine) regulations in other states. While the laws vary from state to state, the majority (and all of the states bordering Texas) continue to require a medical license for the state in which the patient is located.
- Providers should only provide telehealth services to patients who are physically located in Texas.
- Except in situations where the patient (new or established) is physically located in another state, AND the provider holds a license/permit in that state (emergency permits are acceptable).
A list from the AAMC of current licensure rules (as of 3/26/2020) is available in the COVID-19 Response Temporary Licensure Chart.
- Given the recent Texas Executive Order, the emergency permit to provide telemedicine in LA for the next 60 days is found at http://www.lsbme.la.gov/licensure/index
- To request a detailed legal analysis for a specific, high priority or dire situation, please email the ICC.
